Appeal of creators and audiovisual artists to Prime Minister Mateusz Morawiecki

Polish creators and audiovisual artists are waiting for a law that will guarantee all filmmakers fair remuneration from the Internet and provide them with a level playing field in cooperation and negotiations with streaming platforms. This is guaranteed by the EU Directive on Copyright in the Digital Single Market, the implementation of which in Poland has already been prolonged, for reasons we do not understand, for many months. As representatives of the community of Polish actors and filmmakers, we are concerned to see that some representatives of the governing party put the interests of Internet platforms such as Netflix above the good of Polish culture

Dear Prime Minister,

Polish creators and audiovisual artists are waiting for a law that will guarantee all filmmakers fair remuneration from the Internet and provide them with a level playing field in cooperation and negotiations with streaming platforms. This is guaranteed by the EU Directive on Copyright in the Digital Single Market, the implementation of which in Poland has already been prolonged, for reasons we do not understand, for many months. As representatives of the community of Polish actors and filmmakers, we are concerned to see that some representatives of the governing party put the interests of Internet platforms such as Netflix above the good of Polish culture.
 

It is difficult for us to understand why streaming services can share their profits with creators in almost all of Europe, but not in Poland? Why exactly is Polish culture discriminated against by digital giants? That is why we are appealing to the Prime Minister to pass the law that will protect Polish culture which is also the important part of the European culture.

 

The government's draft amendment to the copyright law, for which we are grateful, provides an opportunity for thousands of Polish creators to receive fair remuneration for their work and for their films, which are immensely popular, both in Poland and around the world. That's why we were very surprised to learn that after the Netflix founder, Reed Hastings, visit in Poland in December 2022, Deputy Minister of Digitization Janusz Cieszynski and later Deputy Minister of Finance Piotr Patkowski have sent letters to the Ministry of Culture demanding the deletion of a key provision for Polish creators. We also find it ponder that government officials put the interests of foreign companies above those of Polish creators and Polish citizens.
 

Revenues of VOD platforms in Poland already amount to PLN 2.3 billion (!) per year, at the same time Polish filmmakers receive exactly PLN 0 in royalties. And yet it is thanks to their films that companies like Netflix can make money at all. Not only is the entire Polish film industry losing out on this, but also the Polish economy. It wonders us why Polish filmmakers can receive royalties from other European countries where Polish films or series are watched (France, Italy, Spain, Slovenia, Lithuania or Estonia), and still cannot count on them in their own country, where they are most popular. We also find it surprising that Polish TV stations such as Telewizja Polska, Polsat or even TV Trwam pay royalties to Polish creators, while foreign digital giants are no longer willing to provide such remuneration.
 

Faced with the uncertainty of tomorrow and the lack of transparency about how changes fundamental to the interests of the entire industry are being handled, the community of Polish actors and filmmakers has united across divisions and political sympathies to speak with one voice.
 

On behalf of all Polish filmmakers, we appeal to you and the Law and Justice (PiS) government to implement the directive with provisions ensuring the right to fair remuneration from the Internet!
