SFP-ZAPA Announces Harmonized Re-emission Payback Rules

SFP-ZAPA is pleased to announce the harmonization of producer reissue repartition principles with copyright repartition standards. This vital initiative ensures a cohesive approach in distributing amounts to Polish rights holders, incorporating gradation variables based on the type of work, mirroring the approach used in copyright repartition.

By the resolution of the SFP-ZAPA Repartitioning Board dated June 21, 2023, repartitioning for producers in the field of rebroadcasting exploitation will be carried out as follows:

  1. Types of Audiovisual Works: The repartition will consider various types of audiovisual works protected by SFP-ZAPA, as outlined in Resolution No. 31/2021 of the SFP-ZAPA Administrative Council dated June 23, 2021, and shall apply the rates outlined in this resolution accordingly;
  2. Television Program Broadcasts: The repartition will account for works broadcast in television programs, the list of which will be adopted annually by the Repartition Board under § 17(2) of the Repartition Regulations;
  3. Revenue Division: Revenue from rights will be divided based on the duration of the audiovisual work and its audience, ensuring a fair and equitable distribution.

 

This harmonization effort underscores SFP-ZAPA's commitment to transparency, fairness, and consistency in remuneration practices. By aligning producer reissue repartition principles with established standards, SFP-ZAPA continues to uphold the rights and interests of Polish rights holders.
